Can I avoid losing my driver’s license?—By Kris
I am 18 in the state of GA, and yesterday I got a speeding ticket for 56 in a 25. In my defense, it was one of those with a ridiculously low limit that cops tend to exploit. But that’s irrelevent. Fact is that I face losing my license as a speed more than 24 miles over will get me 4 tasty points! This is my first traffic offense, and I’m wondering: Is there any way that the court might not suspend my license? Anything I can do?

As you know Georgia has special statutes for drivers under 21. I would consult a lawyer to avoid points and a 6 month suspension.
I’m not a big fan of litigation, but everybody wins, the state gets their money and you get a clean record (and your license).

“Ridiculously low speed limit”???? I hate to rain on your parade but speed limits are there for a reason. You were going more than double the speed limit. That constitutes reckless driving, in addition to speeding. Yes, you will likely face a minimum 6 month suspension, probation, fines and higher insurance.

Well, it depends on how stiff the penalty is and from what you are saying it is pretty stiff. I think what you need to do is either state your case, or pay the fine. Now if the state says that you will lose your license if you have a total of four points on it, then there is nothing that can be done. Even though this is your first offense, there are laws to be followed and consequences. You will in essence lose your license for a short period of time for breaking the law at this magnitude. You could state your case for a enrolling in a defensive driving course but that may not work.

If GA has laws that state you will lose your license for this offense or for a first offense such as excessive speeding like this, then you’ll lose your license for a period of time.

Be honest with the judge and ask him or her if its possible to take a defensive driving course….this way you wont have the ticket or the points on your record, best of luck.
