Car Accident Case Question
Firstly Hope all of our autos fans never get into Car Accident:) Here is a trouble about Car Accident Case with Sunshiner.

I was involved in an accident, I was going straight, and a lady made a left turn in front of me. Neither one of us had stop signs, but since she was turning into traffic, it’s considered her fault…the speed limit there is 25, if I was traveling 30mph or so, can that really damage my case?The cop new I was going 30ish, still said it was her fault, my insurance company said it was her fault, but I’m worried that her company will have an issue with the speed thing…
She was only able to turn left or right, so she was merging in, so I had the right of way.

They may assign you a percentage of the blame for going over the limit, but since she was turning left it was clearly mostly her fault. You might see a 90-10 split, but I’d expect more like 95-5,
You own agent would be the best person to get information from.

if both of you came to an unmarked crossing at the same time, the person driving on the right side has the “right of way”. that would be the lady who was on your right hand side. sorry pal.

If its in a police report it may be brought up. She neglected to look both ways before turning and basically merged into your lane. If the police report says you were speeding then that will be brought up. If the officer who responded to the accident did not ask you, you didnt say and he did not report it; I would say I was going 25 and she came out of nowhere. Even at 30, you were only 5 over the limit. If anybody asks you, you were going 25mph
