Ok so I have a question I was sitting at a stop sign that goes to a two way street which has a lot of traffic going both directions. Well I moved a little to the front but the car behind me rear ended me and hit my bumper and he claims that it was my fault because I moved a little to the front but I told him that he should be paying attention that it was not my fault plus he rear ended me so that makes it his fault. So anyways he didn’t give me his insurance because he said he didn’t have it he only gave me his name and address and told me which insurance he had. However, there was no police report done but I called to ask him for the policy number for his insurance and he told me he was going to call his insurance first because he said it was my fault but my information wasn’t given to him by me so is there anything I can do to open a claim? And anytime someone rear ends you is it always their fault?

It is a rare instance where an insurance company can deny for rear ending someone. It is almost 100% at fault for the person who rear ends you for driver inattention or not keeping an assured clear distance. I had an exact claim like yours where my policyholder moved forward after stopping but realized the coast was not clear, and the other party rear ended her citing she moved thus being at fault. I got the phone call from the Lady’s husband who was a lawyer and he threatened that his insurance company should not pay our policyholder. Guess what his insurance company paid us.
1st off, report this to the police asap. 2nd, call your insurance company for guidance. He bullied you into not calling the police and you may end up paying for this if your insurance company cannot locate him or he refuses to provide his insurance info. I would not count on him filing a claim with his insurance company since he by some idiot thought believes you are at fault, so why would he file on his insurance?
Don’t keep calling him, you will get nowhere and get frustrated. Let your insurance company handle and guide you.

95% of the time if someone rear-ends another vehicle, it is their fault. In this situation, it would be the other drivers fault. He should have maintained proper distance and attention, which he failed to do. You can still file a police report. Just contact your local police department and provide them with the info. If he gave you the name of his insurance company, look it up online under their claims dept. Contact the insurance carrier and provide them all of the info that he gave you and they should be able to look up his policy # and you can report the claim. Hope this helps!!

Just because someone rear ends you, does NOT make it 100% their fault.
So right off the bat, you’re already making assumptions that you shouldn’t.
Further, you didn’t get a police report, or any witness statements.
So, call your insurance if you want, but it’s currently your word versus his.
And in those cases, the insurance companies will sit down and debate what happened. And more than likely, find both of you equally at fault.
